You agree to these terms by using our services and/or registering an account with us. These rules should be read in conjunction with our Privacy Notice. 

DEFINITIONS

Us, We, Our means Shaftesbury Casino Limited (Registered Company Number 10071143).

You means you as a customer or visitor to our Premises.

Premises means premises from which Gaming or other services are provided by us.

Gaming means gambling as permitted and licensed by UK law and regulation.

Member means customer who has signed up for Our membership.

Management means the management team in the club, advisers and directors.

Member of Staff means employee of Shaftesbury Casino.

Privacy Notice means Our privacy statement.

Rules means any terms and conditions which applies to your interaction with us, including, but not limited to Gaming Rules, Club Rules, Privacy Policy, Any our promotional offer terms.

RULES

  • You agree to comply with all or Rules and acknowledge that breach of the any Rules may likewise result in barring or exclusion from our Premises, voiding of bets (including innings), or further action as set down in, or otherwise required by those Rules or the terms of our gaming licences

AMENDMENTS

  • These Rules may be occasionally amended and/or updated. Your continued access to our Premises, Gaming, or use of other services shall indicate your acceptance of any amended Rules.

ENRTY

  • We have the right in our sole discretion to approve or refuse any customer entrance to our Premises, or to suspend a customer for any reason at any time.
  • We are not required to give any reasons or right of appeal in respect of any such decision and all such decisions by Us are and shall be final.

AGE

  • You must be 18 years or older to be permitted entry to our Premises.
  • Any person appearing to be under the age of 25 will not under any circumstances be allowed to enter the Premises without showing valid photographic ID which must be legible, with no visible signs of tampering or, reproduction and, positively confirm the date of birth.

MEMBERSHIP

  • All applications for membership shall be person, valid ID must be produced and recorded before full membership status is granted.
  • You may resign your membership by giving notice to Us in writing.
  • The Manager will be entitled to re-instate membership where suspension has taken place and where they wish the suspension to be revoked.
  • You shall notify Us of any changes to your personal details.
  • Any Member who lends their membership card to another person or allows it or their details to be used to enable another person to gain entry to the Premises or to represent themselves as a member may have their membership revoked.
  • We have the right to refuse entry to any Member or Non-Member.

PERSONAL DATA & PRIVACY

  • Your privacy is very important to us – we do not sell or rent your personal details.
  • All customer details are kept on files administered by the Data Controller, Shaftesbury Casino, 377 High Street, West Bromwich, B70 9QW and will be used for Our purpose only.
  • You agree to our right to require suitable documentation, either before admittance or, as required as we see fit. Any images and personal information of you constitutes as ‘personal data’ and You agree that We may retain, use and disclose (if necessary) this data any time as set out at our Privacy Notice – this is to comply with law and regulations applicable to us.
  • We reserve the right to transfer your personal data to law enforcement, regulatory and industry bodies for purposes set out in that policy including the prevention and detection of any actual or suspected crime, fraud, cheating, and administering any self-exclusion).
  • The premises are covered by Facial Recognition, CCTV and Audio Surveillance and may capture audio and images while You are in Premises. All data control enquires should be made in writing to the DPO.

GAMING

  • No game shall be played on the premises other than those permitted in accordance with the Gaming Act 2005 and the regulations made there under and the regulations of the Gambling Commission.
  • All Gaming in Premises takes place in accordance with the Rules applicable. We may void or cancel bets or winnings for any contravention of the Rules.
  • We have the right not to pay and Gaming winnings in circumstances where we know or have reasonable knowledge of suspicion that You have won the money by any way of cheating.
  • Any moneys/chips gained through illegal, irregular or fraudulent play will be confiscated and placed on Our deposit account pending investigation. The result of the investigation will dictate the outcome of the funds.
  • The money lending or provision of credit or loans between customers for Gaming purposes is prohibited.
  • With no exception, no credit shall be given to enable any person to take part in Gaming or in the respect of losses incurred by any person in Gaming.
  • Participating in Gaming on behalf of any other person not present on the Premises at the time and is prohibited.
  • Mobile devices cannot be used whilst Gaming (whether at the gaming tables, electronic gaming tables, at or near any machines, or in our card room).

CUSTOMER FUNDS

  • We do not hold customer funds deposited at the Cash Desk in protected accounts in case of insolvency. The funds will be forfeited at Our discretion if not claimed within 90 days.

LIABILITY

  • We, Management, nor staff is or will be liable to you for any direct, indirect or consequential losses arising from your Gaming or use of our other services or our Premises.
  • We do not exclude liability for personal injury or death arising from our negligence or where liability cannot be excluded or limited as a matter of law.

SOCIAL RESPONSIBILITY

  • As a responsible operator we acknowledge some of customers may experience problem gambling therefore We may interact with You and/or provide detailed information in Premises You may want to acknowledge to address any gambling related problems you may have.
  • You will not attempt to enter our Premises or gamble whilst subject to a self-exclusion or to otherwise circumvent any controls or limits that are in place for responsible gambling purposes. You acknowledge that, should You do so we cannot be held responsible nor liable for any matter arising from entry or play in breach of a self-exclusion or circumvention of measures and controls and, monies staked by You and any winnings arising therefrom (if any) may be forfeited.

GAMING DISPUTES

GENERAL

  • The permitted opening hours of the club are displayed within the premises.
  • The use, adaption or copying our names, trademarks, logo’s, branding, content or copy, nor our Premises details, nor otherwise imply any association or endorsement from us for any reason whatsoever is not permitted.
  • Cameras or any other devices for taking photos or audio-visual footage are prohibited without our prior consent.
  • We reserve the right to conduct searches of customers persons and personal effects at any time in the interest of the safety and security of our customers and staff and we reserve the right to refuse permission to customer to carry any articles or personal effects which we consider inappropriate for passage into our Premises.
  • Customers whose personal apparel is considered unacceptable may be refused entry.
  • Any customer who abuses or threatens either a Staff or any other customer may be asked to leave the Premises and have their Membership revoked.
  • Customers and Staff have the right to be treated with dignity and respect. We thus reserve the right to eject customers or otherwise take appropriate action as we deem fit where customers engage in or, are alleged to have engaged in, inappropriate, discriminatory, threatening, aggressive or harassing actions or conduct (including circumstances where the greater safety or wellbeing of the rest of our customers or staff is or may be in issue).
  • Social or personal relationships formed between customers and Staff are forbidden outside of the Our Fraternisation Policy. In the event You enter into a relationship with a member of Staff You must disclose that relationship to the Management. Breach to this rule may have your Membership terminated and render the member of Staff liable for possible dismissal.
  • Any conduct contrary to law or calculated to or liable to injure the name or reputation of Us is prohibited.

PERSONAL AFFECTS & PROPERTY

  • No property of any kind belonging to the club shall be removed from the premise. We not responsible for the loss of any property belonging to You.
  • All property/personal effects brought onto our Premises remain at your sole risk and that We, our Management or Staff cannot accept responsibility for loss or damage to customer property occurring at our Premises. It is your own responsibility to keep such items safe and secure.

PARKING

  • Parking facilities at our Premises are offered at your sole risk and cost and that We, our Management or staff cannot accept responsibility for loss or damage arising from your use of those facilities.
